The following delivery and payment terms are part of all our offers, invoices, contract acceptance declarations, deliveries and services.
ยง 1 Warranty
The customer's warranty rights are governed by the general statutory provisions.
ยง 2 Offer and Conclusion of Contract
(1) The presentation of goods and services in the online shop does not constitute a binding offer by the provider to conclude a contract. The customer is merely invited to submit an offer by placing an order.
(2) By clicking the 'Buy Now' button, the customer submits a binding offer to conclude a contract. Directly above the 'Buy Now' button is a summary of the order including the conditions for using Slim-XR Online (see ยง 6). The customer then provides their desired delivery address and payment method.
(3) The provider confirms receipt of the customer's order by sending a confirmation email. This order confirmation constitutes acceptance of the contractual offer by the provider.
ยง 3 Withdrawal, Returns and Refunds
(1) Withdrawal: our Withdrawal Policy
(2) Money-back Guarantee - Returns and Refunds:
(a) The provider offers the customer a money-back guarantee for a period of 30 days from receipt of delivery.
To claim the money-back guarantee, the customer must notify the provider of their complaint by email. The provider will then communicate the return address.
The customer sends the goods with sufficient postage, including already opened or empty packages, and the brochure to the communicated return address. After receipt of the shipment, the amount will be refunded.
(b) Refund process:
The customer informs the provider by email or in writing of their wish to return and receives the address for the return shipment.
The customer sends the goods at their own expense with sufficient postage to the specified return address.
The refund is made within 14 days of receipt of the return and inspection of the goods. The amount will be refunded to the bank account specified by the customer or to the original payment method.
(c) Exclusion of refund:
- Services or subscriptions that have already been fully provided are excluded from refund.
- If the customer does not provide sufficient postage for the return, the provider may reduce the refund accordingly.
(3) Notes:
Please keep the shipping receipt and tracking number, if applicable, to ensure that the return reaches the provider.
ยง 4 Shipping
(1) Shipping takes place immediately after receipt of payment.
(2) The standard delivery time is 1 - 3 days for delivery to Germany.
The shipping time for deliveries within Europe is usually 2 to 4 days, worldwide up to 10 days.
Information about delivery times or dates is approximate and not binding.
ยง 5 Payment Terms
We deliver the goods directly after receipt of payment.
Payment can be made using the payment methods listed on the order page.
ยง 6 Slim-XR Online
(1) You can use Slim-XR Online free of charge for 20 days.
(2) After the 20 days, you will continue to use Slim-XR Online for a fee.
The conditions and fee can be found on our website www.slim-xr.info and in the order dialog directly above the red 'Buy Now' button.
The fee per day is highlighted there in bold.
(3) We charge you for Slim-XR Online on a daily basis. Billing takes place after the end of each month.
(4) Cancellation is possible at any time, daily and without notice, by email, letter or fax.
(5) Regardless of your right to cancel at any time, your right of withdrawal applies. Here you can find: our Withdrawal Policy
(6) Payment for Slim-XR Online is made via a payment method chosen by you during an order. A different payment method is possible. Please let us know by email.
(7) Changes to price and subscription offer. We are entitled to change the price of our subscription offers from time to time at our reasonable discretion to reflect the effects of changes in the overall costs associated with our service. Examples of cost elements that affect the price of our subscription offers are production and licensing costs, costs for the technical provision and distribution of our service, customer service and other sales costs (e.g. invoicing and payment, marketing), general administration and other overhead costs (e.g. rent, interest and other financing costs, costs for personnel, service providers and services, IT systems, energy) as well as government-imposed fees, contributions, taxes and levies. All price changes take effect no earlier than 20 days after notification to you. You can cancel your membership at any time on a daily basis to avoid future charges.
ยง 7 Terms of Cancellation for Slim-XR Online
(1) Cancellation by the customer: The customer can cancel Slim-XR Online at any time on a daily basis without notice by sending a written notification by email or post to the provider. Additionally, cancellation is possible via a form accessible on the website through the 'Cancel contract' link.
(2) Cancellation by the provider: The provider reserves the right to cancel Slim-XR Online for good cause, particularly in the event of violations of the Terms & Conditions, illegal conduct or misuse of the service. The provider will inform the customer of such cancellation in writing.
(3) Effect of cancellation: Upon cancellation of the account, access to all services and content ends. A pro-rata refund of fees already paid is only made if required by law.
ยง 8 Resale and Use of Trademarks
(1) The customer may only resell the delivered products exclusively as the original set consisting of:
- printed brochure 'Successfully losing weight',
- Slim-XR capsules,
- individual access code to the Slim-XR Online portal
Resale of already opened, partially emptied or damaged packages is prohibited.
(2) The use of our trademarks and marks is only permitted if paragraph 1 is complied with.
(3) If an entrepreneur culpably violates paragraph 1 or 2, they shall pay an appropriate contractual penalty, the amount of which we shall determine at our reasonable discretion; in case of dispute, the appropriateness is subject to judicial review. The assertion of further damages remains unaffected.
ยง 9 Complaints and Disputes
(1) Complaints: Customers can submit complaints in writing by email or letter. We endeavour to process all complaints within 14 days. Please include your full name, contact details and a detailed description of the matter in your complaint.
(2) The European Commission provides a platform for online dispute resolution (ODR) which you can find at https://ec.europa.eu/consumers/odr/. Consumers have the option of using this platform for the resolution of their disputes.
(3) We are neither willing nor obliged to participate in dispute resolution proceedings before consumer dispute resolution bodies.
ยง 10 Choice of Law & Jurisdiction
(1) The law of the customer's country of residence shall apply to the contractual relationships between the provider and the customer, provided the customer is resident within the European Union. The application of the UN Convention on Contracts for the International Sale of Goods is excluded.
(2) If the customer is a merchant, a legal entity under public law or a special fund under public law, the law of the provider's registered office shall apply to the contractual relationships between the customer and the provider, notwithstanding paragraph 1.
(3) The place of jurisdiction for all disputes arising from the contractual relationship between the customer and the provider shall be the registered office of the provider, provided the customer is a merchant, a legal entity under public law or a special fund under public law.
